THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SEARCH AI DOES NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEARCH AI AND ITS AFFILIATES, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, INTERRUPTION OF BUSINESS, LOSS OF DATA, REPUTATION DAMAGE, OR SYSTEM FAILURES. ADDITIONALLY, SEARCH AI'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE USE OF THE SERVICE SHALL NOT EXCEED ONE-HUNDRED ($100) DOLLARS. SEARCH AI IS ALSO NOT LIABLE FOR EVENTS BEYOND ITS REASONABLE CONTROL, INCLUDING TECHNICAL FAILURES OR SERVICE OUTAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless Search AI, its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) that arise from:

  • Your use or misuse of the Service, including actions taken by others using your account.
  • Your violation of these Terms or any applicable laws.
  • Any third-party claims related to content or information you submit via the Service.

10. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Delaware.
  • Any disputes will be resolved through binding arbitration in Delaware.
  • Users waive rights to class action lawsuits related to the Service.

11. General Provisions

  • If any part of these Terms is found unenforceable, the remainder will remain in effect.
  • Search AI's failure to enforce any provision does not waive its right to do so in the future.
  • These Terms constitute the entire agreement between you and Search AI regarding the Service.
